One of the most effective laws in Florida that protects consumers is known as the Florida Deceptive and Unfair Trade Practices Act (FDUTPA) which is governed on Florida Statutes Chapter 501. FDUTPA protects consumers from business enterprises that engage in unfair methods of competition, or unconscionable, deceptive, or unfair acts or practices in the conduct of any trade or commerce. FDUTPA also contains an attorney’s fee provision that allows a prevailing party in a lawsuit under the statute to collect his or her attorney’s fees from the non-prevailing party.
